KBEM Jazz88 – STANDARD SWEEPSTAKES AND CONTEST OFFICIAL RULES NO PURCHASE OR PAYMENT NECESSARY. BY ENTERING OR PARTICIPATING, EACH ENTRANT AGREES TO THESE OFFICIAL RULES.
1. Eligibility: KBEM sweepstakes and contests are open to listeners 18 years or older (or 21 years of designated by Sponsor for any particular sweepstakes or contest) who are residents of the state of Minnesota or who reside within 250 miles of the Twin Cities area. Employees of KBEM-FM, and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members of each such employee are not eligible to enter or win. Additionally, you (nor can any member in your household) cannot have won any prize (regardless of the value) within 30 days prior to the awarding of a prize in any other sweepstakes or contest. All sweepstakes and contests are subject to all applicable federal, state and local laws and regulations and these official rules. Participation in any sweepstakes or contest constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth in these Official Rules. Contests may limit eligibility to persons of a certain age, who live in a given geographic location, or who work in a particular job, by way of example. Contestants are responsible for determining whether such eligibility limitations apply to a particular contest or promotion.
2. The Station Facebook/Instagram and/or any other social media contests and sweepstakes are not sponsored, endorsed, administered by or associated with said media company. By entering, you are providing the information to the Station, and not the media company. In its discretion, KBEM may require winners to sign a release form to receive the prize. In such a case, the winner will not be entitled to receive the prize without signing the release.
3. Prizes and Approximate Retail Values (“ARV’s”) – The specific prize(s) and ARV of each prize available to be won in each sweepstakes or contest will be determined by the sponsor. Prizes consist of only those items specifically listed as part of the prize. Taxes are winner’s sole responsibility. Prizes are not transferable, substitutable, and may not be redeemed for cash. Sponsor reserves the right to substitute any prize, or portion thereof, for any reason at Sponsor’s sole discretion. Any limitations on any prize will be provided at the time the prize is awarded. All prizes are subject to the terms, conditions and restrictions accompanying the prize. In the event a concert or event is canceled, postponed or delayed, the winner forfeits their right to the prize once it becomes unavailable for any reason, at Sponsor’s sole discretion and no alternate prize will be awarded in such instance. All events and concerts are subject to the rules, restrictions and requirements of the venue the event or concert is taking place. A 1099 form may be submitted to all appropriate taxing authorities for any individual who receives $600 in prizes over the course of a calendar year from KBEM.
4. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify any sweepstakes or contest, or any part thereof, for any reason whatsoever, including, without limitation, fire, flood, natural or man-made epidemic of health of other means, earthquake, hurricane, explosion, labor dispute or strike, act of God or public enemy, satellite or
equipment failure, riot or civil disturbance. Contestants can be disqualified at any time for any reason by the station management.
5. Publicity Release: Acceptance of any prize constitutes winner’s consent to Sponsor to use, publish, and reproduce for all purposes, including publicity, promotion and advertising, in any medium (including online and offline) the prize winner’s name, city, (photograph, likeness, voice and image, if provided by winner), in perpetuity without further compensation, credit or right of review or approval. 10. Limitations of Liability: The Released Parties and their respective parents and affiliates, are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in a sweepstakes or contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry or participation process; (4) technical or human error which may occur in the administration of a sweepstakes or contest, or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in a sweepstakes or contest, or receipt or use or misuse of any prize. 11. Disputes/Governing Law: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with a sweepstakes or contest, or the prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state court of Minnesota; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering a sweepstakes or participating in a contest, but in no event attorneys’ or legal fees; and (3) unless otherwise prohibited, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with a sweepstakes or contest shall be governed by, and construed in accordance with, the laws of the State of Minnesota without giving effect to any choice of law or conflict of law rules (whether of State of Minnesota or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota.
